We call each of our online orders by telephone to get answers to any of questions that are required to activate service so your medical alarm can be shipped immediately. In addition, you will have the option to change any information on the paperwork accompanied by the medical alarm. Please note, you are more than welcome to update or make any changes to your service before, or after, the medical alarm is delivered.

General Terms & Conditions 1. This Contract is between Family First LLC and the Payer and or Subscriber hereinafter referred to the “Customer” as identified on this website form. Both Family First LLC and the Customer agree to the General Terms & Conditions below: 2. Family First LLC agrees to provide 24-hour monitoring service to the Customer from the medical alarm equipment provided by Family First LLC. Family First LLC shall use reasonable efforts to orally notify the appropriate emergency agency or other person(s) designated on the Responsible Person or Party list. This may require Family First LLC to release any information on electronic or paper forms deemed necessary to assist with medical monitoring activities. 3. The Customer agrees test the provided medical alarm monthly and that all activity is electronically logged and recorded. 4. Customer Satisfaction – The Customer has thirty (30) days to notify Family First LLC if they are not satisfied with the reason to request a refund. In addition, the medical alarm must be in working, usable condition and returned to Family First LLC within those thirty days to receive a full refund. 5. Confidentially – Family First may use any Customer information provide internally to assist with medical alarm monitoring services. Family First LLC will not sell Customer names, address or other personal information. 6. The Family First Medical alarm has been tested and does work with Voice Over IP (VoIP) or telephone service through an internet provider. However, VoIP does not have the quality and reliability to consistently send test and emergency signals to the monitoring center. Family First LLC recommends a standard, traditional phone line provided by a local or state telephone company. 7. Family First is not responsible for any interruption in service due to any cause due to acts of god or other beyond control. Family First LLC is not responsible for any injury, loss or damaged caused by the use of the provided medical alarm or medical alarm monitoring service. Because it is impractical and extremely difficult to ascertain the amount of actual damages which Subscriber may incur due to the failure of monitoring services or the Emergency Response System, if, notwithstanding any provision of this Agreement to the contrary, Family First should be held liable to Customer, such liability shall be limited to an amount equal to six (6) months monitoring service fees paid by Family First LLC to the Customer or Two Hundred Fifty Dollars ($250.00), whichever shall be greater. The Customer agrees that the receipt of such amount by Family First shall be the Subscriber’s sole and exclusive remedy against Family First LLC 8. The Term of Contract starts on the date the medical alarms is shipped to the Customer and is Annual, Quarterly, or Monthly as selected on this web form. Due to liability Family First LLC does not give advanced written notice for cancellation of services. Accounts are considered billable and active until the medical alarm is returned to Family First LLC. By accepting this contract the Customer authorizes Family First LLC to charge the Customer’s credit card or debit checking account for payment. The Customer agrees to pay in full the monitoring service until the equipment is returned to Family First LLC. Family First may elect to post a late fee of $10.00 per month on any past due balance. Family First LLC may charge the customer $299.00 for any medical alarm equipment not returned within 30-days of cancellation. Family First LLC will replace the medical alarm that has not been purchased outright by the customer, that is damaged by acts of god. If the medical alarm becomes lost or damaged due to purposeful or otherwise neglect on the Customers part the Customer agrees to pay a fee up the amount of the medical alarm replacement as stated. 9. Cancellation – This agreement may be cancelled at anytime by returning the equipment to Family First Medical Alarms, 1 Fox Hollow, Ormond Beach, FL 32174. 10. Governing Law – This Agreement will be governed by and is construed in accordance with the internal laws of the State of Florida without regard to its rules concerning conflicts of laws. Should any legal action be initiated with respect to this service agreement, Subscriber consents to personal jurisdiction in the State of Florida and venue in the Seventh Judicial Circuit in and for Volusia County, Florida. 11. Collection - Should Family First pursue legal action for remedies against Subscriber, Family First shall be entitled to attorney's fees and litigation costs in bringing said action, including all post-judgment proceedings. Shipping Information: Family First Medical Alarms process and ship orders the same day received, (orders before 2:00 PM Central Time on any weekday and before 10:00AM on Saturdays) are shipped on that day. If you have chosen Express Delivery Next Day Mail, you will receive your equipment the day after you submit this form.

If the ship to address is in a rural area, the U.S. Post Office may not guarantee Express Delivery Next Day Mail. Family First Medical Alarms will notify you if the US Post Office cannot guarantee next day and ship Express Mail which is guarantee second business day. If you choose Express Mail Next Day, the additional $24.95 difference to next day mail the equipment is applicable regardless if you receive it on the second business day. Once again, when you choose Express Delivery Next Day Mail we will call you to upon receiving this form to let you know when you will receive the equipment.
